Cost of Issuing Legal Proceedings
These costs apply where your claim is in relation to an unpaid invoice which is not disputed and enforcement action is not needed. The table set out below shows the costs involved in issuing proceedings.
The fixed costs are the costs which are recoverable from the debtor and not the costs incurred by us and for which you are responsible. Our costs are based on time spent at an hourly rate in respect of the work carried out on your behalf. Full details of our hourly rates will have been supplied to you prior to the work being carried out on your behalf. The hourly rates are subject to VAT at the prevailing rate.
If the other party disputes your claim at any point, we will discuss any further work required and provide you with estimates about costs where necessary.
Anyone wishing to proceed with a claim should note that:-
- The VAT element of our fee cannot be reclaimed from your debtor.
- Interest and compensation may take the debt into a higher banding, with a higher cost.
- There will be additional costs incurred on a time spent basis for entering Judgment and taking enforcement measures. The costs quoted above are not for matters where enforcement action, such as the HCEO, is needed to collect your debt.
The time from issuing proceedings to being able to enter Default Judgment is generally in the region of 3 to 5 weeks. If enforcement measures are required this may take an additional 10 to 12 weeks.
Where matters are contested we will endeavour to provide timescales for the various stages of the proceedings.
