This Notice explains when and why ERT Law Limited (“ERT”) collect personal information, how we use it, how we keep it secure and your rights in relation to it.
ERT will collect your personal information by correspondence, telephone, e-mail and forms submitted via our website.
The information required from you will depend upon the nature of our relationship with you. We will not collect any personal information from you that is not required for the purpose stated at the time the request for information is made.
We have implemented generally accepted standards of technology and operational security in order to protect personal data from loss, misuse or unauthorised alteration or destruction. However, transmitting information over the internet may not be secure and we cannot guarantee the security of this information.
We will notify you promptly in the event of any breach of your personal data which might expose you to risk.
Your details will be stored securely within our paper storage facilities and our electronic systems.
Under no circumstances will ERT disclose, sell, trade or transfer your personally identifiable information to third parties for marketing purposes.
Any information you provide to ERT will only be used by us, our agents and service providers who assist us in carrying out your instructions, servicing you or conducting our business, so long as those parties agree to keep your information confidential.
We may also release your information when we are obliged or permitted to do so by law, or to enforce our policies or protect ours or others rights, property or safety.
ERT does not generally transfer data outside of the EEA. Should there be a requirement to do so, we will take all necessary steps to enable the safeguarding of your information.
We reserve the right to amend this Privacy Notice from time to time without prior notice. Please check this page regularly for any amendments. Amendments will not apply retrospectively.
Once you become our client and sign our Client Service Agreement, ERT will hold and process your data in order to action your matter. We will hold your data for 7 years from the date your matter is closed.
If you have simply made enquiries with us, we will process your data in order to contact you in response to the information you have requested. We will hold your information and any advice provided for 7 years.
We may however, hold and process your data in order to action a claim made against you or to comply with a legal obligation or to carry out a task in the public interest or where there is a legitimate interest. Your data may be held on our clients file for 7 years from the date the matter is closed.
You have certain rights in relation to the data held. Those rights may include:-
- The right to be informed;
- The right of access;
- The right to rectification;
- The right to erasure;
- The right to restrict processing;
- The right to data portability;
- The right to object;
- Rights in relation to automated decision making and profiling.
